4.142 The policy reaffirms the government commitment to the realization of the child rights. The
policy has identified survival, health, nutrition, education, development, protection and participation
as the undeniable rights of every child, and has declared these as key priority areas.
Protection of Child from Sexual Offences Act, 2012
4.143 The act deals with child abuse cases and provides protection to all children from the offences
of sexual assault, sexual harassment and pornography.
Kerala State Commission for Protection of Child Rights
4.144 The Commission started functioning in the state from 3.6.2013. It has the mandate to examine
and review the existing laws for the protection of child rights, inquire into cases of violation of child
rights, look into factors inhibiting the enjoyment of those rights and suggest remedial measures, etc.
The Commission has been vested with the task of monitoring the implementation of the POCSO Act,
2012 in the state. For this purpose, the Commission had constituted a POCSO cell in 2013.
Integrated Child Protection Scheme (ICPS)
4.145 ICPS provides preventive, statutory care and rehabilitation services to children who are in need
of care and protection and children in conflict with law as defined in JJ Act 2000 and its amendments
in 2006. Lack of reliable data on children in difficult circumstances for planning and co-ordination of
services for them, inadequate and substandard services due to shortage of committed trained and
sensitized personnel at all levels, minimal use of non-institutional care options like adoption, foster
care and sponsorship etc. are the major implementation hurdles.
